Will of Samuel Elzea - 1851

In the name of God Amen - I Samuel Elzea of the County of Marion in the State of Missouri being in very inform state of health, and sensible too of my liability to sudden death, at the same time being according to my own apprehension of sound mind and disposing memory, and being anxious to make a suitable disposition of my real and personal Estate do make and ordain this my last Will and Testament.

FIRST - It is my will that all my past debts and the charges of my funeral be paid and discharched by my Executor herein named and appointed out of my Estate, as soon as conveniently may be after my decease, and I leave the charge of my funeral to the direction of my said Executer.

SECOND - I give, devise and dispose of my Estate real and personal (save whatever shall be necessary for the payment of my past debts and funeral charges) in the following manner:

TO WIT - I give my beloved wife Frances for and during her natural life all my Estate real and personal and mixed of every kind, to be had, kept and used and enjoyed by her for and during her natural life as aforesaid, with full power to dispose of such portion or portions of my personal Esate as she may, with the advice and consent of my said Executor thinks best and proper, during her said life for her own proper maintainance and support and that of my younger children.

THIRD - After the death of my said wife it is my will and desire, and I hereby authorize and direct that my said Executor sell and dispose of in such manner as may be deemed most advantageous all of my Real Estate and on such Sale, to give to the purchasor or purchasors, a credit of One Year on the first payment - two years on the second payment and three years on the third payment, make interest on each payment from date, and with all necessary security on said Real Estate to ensure the payment of the purchase money. And I do further direct, that all of the personal Estate that remain after the death of my said wife shall be likewise disposed of by my said Executor in such manner and upon such terms as he may think most beneficial to my children herein after named.

FORTH - The proceeds arising from the sales of my said Real and Personal Estate as above named I do hereby give and bequeath unto my children - to be divided among them all equally, share and share alike, as follows TO WIT:
To my son John T. Elzea one undivided tenth part thereof, to him and his heirs forever.
To my son Samuel H. Elzea one undivided tenth portion thereof, to him and to his heirs forever.
To my son James A. Elzea one undivided tenth part thereof, to him and to his heirs forever.
To my son Henry S. Elzea one undivided tenth part thereof, to him and to his heirs forever.
To my son Marcus N. Elzea one undivided tenth part thereof, to him and to his heirs forever.
To my daughter Sally Ann (Wife of William Smith) one undivided tenth part thereof, to her and to her heirs forever.
To my daughter Mary Jane Elzea one undivided tenth part thereof, to her and her heirs forever.
To James Alexander Elzea in trust for the sole use, benifit and enjoyment of my daughter Frances A. (Wife of Woodson Johnson) free from the control and direction of her said husband and free from any liabilities or debts of his the said Woodson Johnson now existing or here after to exist. One tenth part thereof to the said James Alexander Elzea in trust as aforesaid and for the use aforesaid of said Frances A. Johnson and her heirs forever.
To my daughter Amanda C. Elzea one undivided tenth part thereof, to her and her heirs forever.
To my daughter Martha K. Elzea one undivided tenth part thereof, to her and to her heirs forever.

FIFTH - It is my will and desire that none of my children to whom I have advanced or loaned any money shall be required to pay any interest therein, but that they may be allowed to retain the same at their elections until the division of my estate as above named, and then it is my will and desire that they pay in the same, and that a division thereof be had and made in the same manner and proportions as above named.

SIXTH - It is my will and desire that all of my children to whom I have made allowances in the way of property shall be charged therewith in a division and settlement of my said Estate, and that each one of said children who have had no allowance shall be made equal with such as him. And lastly I do hereby make constitute and appoint my son James A. Elzea, the Executor of this my last will and Testament at the County of Marion in the State of Missouri this eighteenth day of May in the year of our Lord One thousand eight hundred and fifty one.

Fact 3: He made a Will on February 8, 1858 and filed it on September 4, 1858 in Madison County, Ohio which left all to his wife, Susan, and their six children living. He also left $5 to each of his nine living children by his first wife, Zera.
Fact 4: He was a farmer in Madison County, Ohio
Fact 5: He needed money to settle his debts, so he signed over his inheritance to pay
Fact 6: In the 1850 Census he was living in Madison County, Ohio and he was 60 years old

Notes for SUSAN PATTERSON:
  On October 7, 1887 after her death, her son, Abram and his wife Adella, sold 42 104/160 acres in survey 3464 (part of his parents original farm) to Henry Wright for $2384.20 . This was to be paid in the form of two notes each $17717 to Rebecca Bailey, the same to Helen Ann Moratt and Zerah Funston, and two notes of $81.06 each to Levi A Kilbury. The females are Abram's sisters so this was most likely an Estate settlement.
